Children who are not of legal age, those who suffer or experience sexual activities even with their consent, are termed statutory rape. This is a crime, more like sexual assault, where minors are the victims of sexual harassment, verbal/sexual abuse and rape which are a violation of human rights and against the law. The 2015 Kansas Sexual Harassment Awareness Month says it all.

No Requirement Of Force

This kind of crime does not involve the term force, as the victims are minors and it is presumed that they do not know what they are doing, they did not understand what others are doing on them that is why no force was involved. As a minor, they obediently agreed with what others want to do with them even by harassing them sexually. But if “force” was done, then, it is called child molestation.

Age Of Consent

People who are immature to decide about sexual activities need consent in terms of having sexual activities; some legal age can be 16 or 18 years old. Statutory rape can occur even if the actor is not aware of the age of their victim; it is not an excuse that the minor agreed to do sexual activities with them.

Factors Affecting The Punishment

Punishment for this crime is imprisonment. But some factors can affect the depth of the punishment; age difference of the doer of the act and the victim, and if the actor is a teacher and the victim is their student.

Close-In-Age-Laws

There is what we call Romeo and Juliet law where actors have a close age gap; it has a different set of rules where the actor is slightly older than the victim. But still he or she is not free from punishments, but the sentence can be lowered.

Professionals Required To Report

Professionals like teachers, medical professions, and others have the right to report statutory rape, it is mandated by the law.
